จำนำ

Borrowed from Old Khmer caṃnaṃ, caṃnām, caṃṇāṃ, caṃnāṃ (“recollection, remembrance; to recollect, to remember; etc”), extended form of Old Khmer cāṃ, cāṃma, cāṃmma, cāma, caṃ, cām, cāṃm, cam, from which Thai จำ (jam) was derived. Cognate with Modern Khmer ចំណាំ (cɑmnam).

จำนำ • (jam-nam)

1. (archaic) habitué; regular.
2. (archaic) captive; hostage.
3. (law) pledge.
   • 1926, พระราชกฤษฎีกาให้ใช้บทบัญญัติแห่งประมวลกฎหมายแพ่งและพาณิชย์ บรรพ ๑ และบรรพ ๒ ที่ได้ตรวจชำระใหม่ ลงวันที่ ๑๑ พฤศจิกายน ๒๔๖๘, มาตรา ๗๔๗:

     อันว่าจำนำนั้นคือสัญญาซึ่งบุคคลคนหนึ่งเรียกว่าผู้จำนำส่งมอบสังหาริมทรัพย์สิ่งหนึ่งให้แก่บุคคลอีกคนหนึ่งเรียกว่าผู้รับจำนำเพื่อเป็นประกันการชำระหนี้

     an-wâa jam-nam nán kʉʉ sǎn-yaa sʉ̂ng bùk-kon kon nʉ̀ng rîiak wâa pûu-jam-nam sòng-mɔ̂ɔp sǎng-hǎa-rí-má-sáp sìng nʉ̀ng hâi gɛ̀ɛ bùk-kon ìik kon nʉ̀ng rîiak wâa pûu-ráp-jam-nam pʉ̂ʉa bpen bprà-gan gaan-cham-rá nîi

     As for pledge, it is a contract by which a person, called pledgor, delivers a specific movable property to another person, called pledgee, as security for the performance of an obligation.

     คำว่าจำนองแต่ก่อนใช้ร่วมไปด้วยกับคำว่าจำนำและมีความเหมือนกันเพิ่งใช้ตามความในประมวลกฎหมายแพ่งและพาณิชย์ในสมัยปัจจุบัน

     The term chamnong was formerly used together with the term chamnam and the two were synonymous. They have just been used according to the Civil and Commercial Code in our days.

     tâa sáp-sǐn tîi jam-nam bpen sìt-tí sʉ̂ng mii dtraa-sǎan lɛ́ mí dâai sòng-mɔ̂ɔp dtraa-sǎan nán hâi gɛ̀ɛ pûu-ráp-jam-nam táng mí dâai bɔ̀ɔk-glàao bpen nǎng-sʉ̌ʉ jɛ̂ɛng gaan-jam-nam gɛ̀ɛ lûuk-nîi hɛ̀ng sìt-tí nán dûai sái tâan wâa gaan-jam-nam yɔ̂m bpen moo-ká

     When the pledged property is a right represented by an instrument, if such instrument has been not delivered to the pledgee and debtors of that right have not been notified in writing of the pledge as well, then the pledge is said to be void.
